Terms and Conditions

These Terms and Conditions ("Terms") are a binding agreement between you and José Posada ("Aba", "we", "us") governing your use of the Aba mobile application and website (the "Service"). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements.

2. The Service

Aba is a personal budgeting and money-organization tool. It lets you manually record accounts, transactions, categories, scheduled entries, and reminders, and view calendars and reports based on the information you enter. We may add, change, or discontinue features at any time.

3. Not financial, investment, tax, or banking advice

Aba is an organizational tool, not a financial institution or advisor. The Service:

• does not connect to your bank, import statements, or move or hold money;
• does not provide financial, investment, accounting, tax, or legal advice; and
• relies entirely on data you enter, which may be incomplete or inaccurate.

Any decisions you make based on the Service are your sole responsibility. Consult a qualified professional before making financial decisions.

4. Your account

You sign in using a passwordless email code or a third-party provider (Google or Apple). You are responsible for keeping access to your email/account secure and for activity under your account. Notify us promptly of any unauthorized use.

5. Subscriptions, billing, and cancellation

Aba offers a free tier and a paid "Aba Pro" subscription.

• Billing: Pro is sold as an auto-renewing subscription through the Apple App Store or Google Play and managed via RevenueCat. Payment is charged to your store account at confirmation of purchase.
• Auto-renewal: your subscription automatically renews for the same period unless you cancel at least 24 hours before the end of the current period. Your store account is charged for renewal within the 24 hours before the period ends.
• Managing/canceling: manage or cancel anytime in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
• Free trials/promotions (if offered): any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
• Refunds: purchases are handled by the app stores and are subject to their refund policies. Except where required by law, payments are non-refundable by us.
• Price changes: we may change subscription prices; changes apply to future periods and, where required, only after notice and/or your consent per the store's rules.

6. Free tier and advertising

The free tier is supported by advertising (see the Privacy Policy, Section 6). By using the free tier you agree to the display of ads. Upgrading to Pro removes ads as described in the app.

7. Acceptable use

You agree not to: (a) use the Service unlawfully or for anything other than your own personal budgeting; (b) reverse engineer, decompile, or attempt to extract source code, except as permitted by law; (c) interfere with, overload, or disrupt the Service or its security; (d) access the Service through unauthorized automated means; (e) upload unlawful, infringing, or harmful content, including through the Help & Support form; or (f) resell or commercially exploit the Service without our permission.

8. Your Content

You retain ownership of the accounts, transactions, categories, reminders, and other content you create ("Your Content"). You grant us a limited, worldwide, royalty-free license to host, store, process, and display Your Content solely to operate and provide the Service to you (including generating your reminders and reports). You are responsible for Your Content and represent that you have the right to submit it. Content you send through Help & Support may be used to diagnose and resolve your request.

9. Intellectual property

The Service, including its software, design, branding, and the "Aba" name and logo, is owned by José Posada and its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service under these Terms. All rights not expressly granted are reserved.

10. Third-party services

The Service relies on third parties (including Apple, Google, Convex, Resend, RevenueCat, and Google AdMob). Your use of those services may be subject to their own terms and policies, and we are not responsible for third-party services.

11. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure, or that data will not be lost. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you, and you may have additional statutory rights (including mandatory consumer-protection rights in the EU and Latin America) that these Terms do not limit.

12. Limitation of liability

To the maximum extent permitted by law, José Posada and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or relating to the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) USD $50. Nothing in these Terms limits liability that cannot be limited under applicable law (including mandatory consumer rights).

13. Indemnification

You agree to indemnify and hold harmless José Posada from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or where necessary to protect the Service or comply with law. Sections that by their nature should survive termination (e.g. 8–13, 16) will survive.

15. Changes to the Service or Terms

We may modify the Service or these Terms. If we make material changes to the Terms, we will update the "Last updated" date and, where required, notify you. Your continued use after changes take effect means you accept the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of Colombia, without regard to conflict-of-laws rules. Disputes will be resolved in Colombia, unless mandatory law in your country of residence gives you the right to bring proceedings in your local courts — in which case those rights are preserved. This clause does not deprive consumers of the protection of mandatory provisions of their local law.

18. Apple App Store — Additional Terms (Licensed Application End User License Agreement)

These terms apply when you download Aba from the Apple App Store. You acknowledge that these Terms are between you and José Posada only, and not with Apple, and that Apple is not responsible for the Service or its content. Apple's standard Licensed Application End User License Agreement (EULA) also applies and is available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. To the extent of any conflict between those Apple terms and these Terms, the following minimum terms govern for App Store downloads:

1. Acknowledgement. These Terms are concluded between you and José Posada only, not Apple. José Posada, not Apple, is solely responsible for the Aba application and its content.
2. Scope of license. The license granted to you is a non-transferable license to use Aba on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Aba may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
3. Maintenance and support. José Posada is solely responsible for providing any maintenance and support for Aba. Apple has no obligation to furnish any maintenance and support services.
4. Warranty. José Posada is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Aba fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to Aba.
5. Product claims. José Posada, not Apple, is responsible for addressing any claims relating to Aba, including product-liability claims, claims that Aba fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual property rights. In the event of any third-party claim that Aba or your use of it infringes intellectual property rights, José Posada, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
7. Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Developer name and address. Questions, complaints, or claims about Aba should be directed to José Posada, Cra 70 # 3-19 Medellín, support@getaba.app.
9. Third-party terms. You must comply with applicable third-party terms of agreement when using Aba.
10. Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

19. Google Play — Additional Terms

If you download Aba from Google Play, your use is also subject to the Google Play Terms of Service. You acknowledge that Google is not a party to these Terms and is not responsible for the Service. Subscriptions purchased through Google Play are governed by Google Play's payment and refund policies.
